Terms of Service

These Terms of Service (“Terms”) govern your use of the Visisto platform operated by Visisto Ltd (“Visisto”, “we”, “us”, “our”). By creating an account or using our services, you agree to these Terms.

1. Account registration

To use Visisto, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorised access to your account.

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement. If you are creating an account on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Plans and pricing

2.1 Free plan

Visisto offers a free plan with 15,000 emails/month, unlimited contacts, all 24+ widget types, 3 automated sequences, and full analytics. The free plan has no time limit and requires no credit card. We reserve the right to modify the free plan limits with 30 days’ notice.

2.2 Paid plans

Paid plans (Starter, Growth, Agency) are billed monthly or annually. All plans use flat pricing — no per-contact fees. Prices are listed in GBP and exclude applicable VAT/sales tax. We reserve the right to change pricing with 30 days’ notice. Price changes do not affect your current billing period.

2.3 Billing and payment

Payments are processed securely through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis. Failed payments are retried for up to 14 days before your account is downgraded to the free plan.

3. Acceptable use

You agree not to use Visisto to:

  • Send unsolicited emails (spam) or violate anti-spam laws (CAN-SPAM, PECR, GDPR)
  • Collect personal data without appropriate consent
  • Distribute malware, phishing content, or deceptive material
  • Impersonate another person or organisation
  • Interfere with or disrupt the Visisto platform or its infrastructure
  • Use the platform for any illegal purpose
  • Resell or sublicense access without an Agency plan or written agreement
  • Scrape, reverse-engineer, or attempt to extract source code from the platform

We reserve the right to suspend or terminate accounts that violate these terms. Serious violations (spam, phishing, malware) result in immediate account termination without notice.

4. Email sending and compliance

You are responsible for complying with applicable email marketing laws in your jurisdiction, including GDPR (EU/UK), CAN-SPAM (US), CASL (Canada), and PECR (UK). This includes:

  • Obtaining valid consent before sending marketing emails
  • Including a working unsubscribe link in every marketing email
  • Honouring unsubscribe requests within 24 hours
  • Accurately identifying yourself as the sender
  • Not using purchased, rented, or scraped email lists

Visisto automatically processes unsubscribe requests and bounce notifications. Accounts with bounce rates exceeding 5% or spam complaint rates exceeding 0.1% may be suspended pending review.

5. Your data

You retain full ownership of all content and data you upload to Visisto, including contact lists, email content, widget designs, and analytics data. We do not claim any intellectual property rights over your content.

You grant Visisto a limited licence to process your data solely for the purpose of providing the service (sending emails, displaying widgets, running integrations, generating analytics). This licence terminates when you delete your account.

6. Intellectual property

The Visisto platform, including its design, code, documentation, brand assets, and underlying technology, is owned by Visisto Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without prior written consent.

The Visisto name, logo, and brand marks are trademarks of Visisto Ltd. You may not use them without permission, except to accurately refer to Visisto in editorial content.

7. Uptime and availability

We target 99.9% uptime for the Visisto platform. We do not guarantee uninterrupted access. Planned maintenance windows are communicated in advance via email. We are not liable for downtime caused by factors outside our control (internet outages, DNS issues, third-party service failures, force majeure).

8. Limitation of liability

To the maximum extent permitted by law, Visisto’s total liability to you for any claims arising from your use of the platform is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost data, or business interruption.

9. Indemnification

You agree to indemnify and hold Visisto harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your content, your violation of these Terms, or your violation of any law or third-party rights.

10. Cancellation and termination

You can cancel your paid subscription at any time from the dashboard. Your account reverts to the free plan at the end of the current billing period. No refunds for partial periods. You retain access to all features until the end of your paid period.

To fully delete your account and all associated data, contact support@visisto.com. Account deletion is irreversible and completed within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.

11. Modifications to Terms

We may update these Terms from time to time. Material changes are communicated via email at least 30 days before they take effect. Your continued use of Visisto after the effective date constitutes acceptance of the revised Terms. If you disagree with the changes, you may cancel your account before the effective date.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be resolved in the courts of England and Wales. If you are a consumer in the EU, you retain any mandatory consumer protection rights granted by the laws of your country of residence.
